Welcome to Sanitize Today.

These Terms & Conditions govern your use of the Sanitize Today website and the purchase and use of products and services supplied by Sanitize Today (Pty) Ltd (“Sanitize Today”, “we”, “us” or “our”).

By using our website, creating an account, placing an order, requesting a quotation or purchasing products or services from us, you agree to these Terms & Conditions where applicable.

These Terms & Conditions must be read together with our Privacy & Personal Information Policy, Refund & Returns Policy, and Shipping, Delivery, Collection & In-Store Availability Policy.

Nothing in these Terms & Conditions is intended to exclude, restrict or waive any consumer right that cannot lawfully be excluded under South African law, including rights under the Consumer Protection Act 68 of 2008 (“CPA”) and, where applicable, the Electronic Communications and Transactions Act 25 of 2002 (“ECT Act”).

Sanitize Today supplies cleaning, hygiene, sanitation, chemical, janitorial and related products and equipment to consumers and businesses in South Africa.

2. Use of Our Website

You may use our website only for lawful purposes.

You may not use our website:

In violation of any applicable law or regulation;
For fraudulent or unlawful purposes;
To interfere with the operation or security of the website;
To attempt to gain unauthorised access to our systems or accounts;
To introduce viruses, malicious code or other harmful technology;
To collect information about other users unlawfully; or
In any manner that may damage Sanitize Today or another person.

We reserve the right to restrict or suspend access to our website where reasonably necessary for security, maintenance, suspected misuse or other legitimate purposes.

3. Website Availability

We endeavour to keep our website available and functioning correctly.

However, we do not guarantee that the website will always be uninterrupted, error-free or continuously available.

We may temporarily suspend, modify, maintain or discontinue any part of the website where reasonably necessary.

4. Customer Accounts

Certain website functionality may require you to create an account.

You are responsible for:

Providing accurate information;
Keeping your account information current;
Maintaining the confidentiality of your login details; and
Informing us if you reasonably suspect unauthorised use of your account.

You remain responsible for activity conducted through your account to the extent permitted by applicable law.

5. Products & Availability

All products are offered subject to availability.

We make reasonable efforts to ensure that stock information displayed on our website is accurate. However, stock levels may change rapidly and website availability does not constitute an absolute guarantee that a product remains available.

An item may become unavailable after an order has been submitted due to:

Simultaneous purchases;
Inventory discrepancies;
Damaged stock;
Supplier availability;
Stock allocated to another location; or
Other circumstances outside our reasonable control.

If we cannot supply an ordered product, we will contact you and provide an appropriate solution in accordance with applicable law.

6. In-Store & Local Inventory

Products displayed as In Stock, Available in Store, Store Collection or similar are based on inventory information available to Sanitize Today at the relevant time.

Local inventory may change before an order is completed.

Customers choosing collection should wait until they receive confirmation that their order is ready for collection before travelling to the relevant collection location.

7. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, specifications, quantities, dimensions and other information displayed on our website are accurate.

Images may be illustrative, and packaging, labelling, colour or appearance may occasionally differ from website images because of manufacturer or supplier changes.

Where an error materially affects an order, we will address the matter in accordance with applicable law.

8. Product Suitability & Intended Use

Customers are responsible for selecting products appropriate for their intended application unless Sanitize Today has expressly advised otherwise.

Cleaning chemicals and related products must be used:

According to the product label;
According to manufacturer instructions;
At the recommended dilution;
With appropriate personal protective equipment where required;
In accordance with applicable safety information; and
Only for their intended purpose.

Customers should not mix chemical products unless the manufacturer expressly states that doing so is safe.

Where safety data sheets or other product-specific safety information is provided, customers should review and follow that information.

Nothing in this section limits rights relating to defective, unsafe, incorrectly supplied or improperly described goods under applicable law.

9. Pricing

Unless otherwise indicated, prices displayed on our website are stated in South African Rand (ZAR).

We make reasonable efforts to ensure pricing is accurate.

Prices may change from time to time without prior notice. A price change will not ordinarily affect an order already validly concluded, except where permitted by law.

If an obvious pricing or website error occurs, Sanitize Today will handle the matter in accordance with applicable South African law rather than automatically treating an erroneous price as binding.

10. Quotations

Quotations issued by Sanitize Today are valid for the period stated on the quotation.

Where no validity period is stated, customers should confirm pricing and availability before making payment.

Quoted pricing may be affected by:

Product availability;
Supplier pricing;
Exchange-rate movements;
Courier or freight charges;
Quantity changes; or
Changes to the customer’s requirements.

Any change affecting an accepted quotation will be communicated where required before the amended transaction proceeds.

11. Orders

Submitting an order through our website constitutes an offer to purchase the selected products.

An automated order confirmation acknowledges receipt of the order but does not necessarily mean that every item has been physically allocated or dispatched.

Orders remain subject to:

Product availability;
Payment authorisation;
Verification where reasonably required;
Delivery limitations; and
Acceptance by Sanitize Today.

Where we are unable to fulfil an order, we will communicate with the customer and provide an appropriate remedy.

12. Payment

Payment must be made using one of the payment methods made available by Sanitize Today.

Orders may not be released, dispatched or made available for collection until the required payment has been received or appropriately authorised, unless alternative payment terms have been agreed in writing.

Payments processed by third-party payment providers may also be subject to the provider’s terms and security requirements.

13. Ownership of Goods

Unless otherwise agreed in writing, ownership of goods remains with Sanitize Today (Pty) Ltd until payment for those goods has been received in full.

Risk in goods will transfer in accordance with applicable law and the circumstances of delivery or collection.

This clause does not limit any statutory consumer rights.

14. Delivery

Delivery is governed by our Shipping, Delivery, Collection & In-Store Availability Policy.

Standard shipping rates, bulk shipping conditions, outlying-area charges and other delivery requirements are set out in that policy and, where applicable, on individual product pages.

Delivery dates and times provided are estimates unless expressly agreed otherwise.

Courier delays may occur because of circumstances outside Sanitize Today’s reasonable control.

15. Additional Courier Charges

Certain orders may require additional courier or freight charges because of:

Weight;
Dimensions;
Volumetric weight;
Quantity;
Destination;
Outlying-area classification;
Hazardous-goods requirements; or
Other special transportation requirements.

This may apply particularly to bulk orders, large containers, drums, cleaning equipment and oversized products.

Where an additional charge is required after an order is submitted, we will contact the customer before dispatch where appropriate.

If the customer does not wish to accept the additional charge, the order will be handled in accordance with our Refund & Returns Policy and applicable law.

16. Store Collection / Click & Collect

Where Store Collection is available, customers may select an eligible collection location during the ordering process.

No standard courier charge applies to an order collected from the selected location where the order qualifies for collection.

Customers must wait for ready-for-collection confirmation before travelling to collect an order.

We may request:

Order confirmation;
Proof of identity; or
Appropriate authorisation where another person collects on the customer’s behalf.

17. Uncollected Orders

Customers should collect orders within a reasonable period after receiving confirmation that the order is ready.

If an order remains uncollected, Sanitize Today may contact the customer using the details supplied with the order.

Where goods remain uncollected for an extended period, Sanitize Today may take reasonable steps permitted by applicable law to address storage, collection, cancellation or disposal of the goods.

Sanitize Today will not automatically sell a customer’s paid goods after seven days or automatically forfeit the customer’s refund solely because the order was not collected within seven days.

This replaces the old clause and is much safer.

18. Returns, Refunds & Exchanges

Returns, refunds and exchanges are governed by our Refund & Returns Policy and applicable South African law.

Depending on the circumstances, return eligibility may be affected by:

Whether the product has been opened;
Whether seals have been broken;
Whether the product has been used;
Product condition;
Hygiene considerations;
Chemical contamination;
Whether the product was custom or specially ordered;
Whether the product is defective;
Whether the incorrect product was supplied; and
Applicable statutory rights.

Nothing in these Terms & Conditions overrides rights available under the CPA, ECT Act or other applicable legislation.

19. Defective Products & Warranties

Products that are allegedly defective may be inspected or assessed by Sanitize Today or, where appropriate, the manufacturer, importer, distributor, supplier or authorised service provider.

Where the CPA or other applicable law provides the customer with statutory remedies, those rights will be honoured.

Additional manufacturer or supplier warranties may also apply to certain products.

Any additional commercial warranty does not replace statutory consumer rights.

20. Incorrect or Damaged Orders

If you receive:

The incorrect product;
An incorrect quantity;
A materially damaged product; or
An incomplete order,

please contact Sanitize Today as soon as reasonably possible.

We may request photographs, order details, packaging information or other reasonable information to investigate and resolve the matter.

21. Chemicals & Safety

Certain products sold by Sanitize Today may contain chemicals requiring careful handling, storage or use.

Customers are responsible for following applicable:

Product labels;
Safety instructions;
Manufacturer directions;
Dilution instructions;
Storage requirements;
Personal protective equipment requirements; and
Safety Data Sheets where applicable.

Products should be kept away from children and vulnerable persons where required by their labelling or safety instructions.

Sanitize Today is not responsible for loss or damage caused by misuse, unauthorised modification, improper dilution, inappropriate mixing, incorrect storage or use contrary to supplied instructions, except to the extent that liability cannot lawfully be excluded.

22. Intellectual Property

Unless otherwise indicated, content appearing on the Sanitize Today website, including:

Text;
Graphics;
Logos;
Website design;
Photographs;
Product content created by us;
Videos; and
Other original website materials,

is owned by or licensed to Sanitize Today and is protected by applicable intellectual-property law.

Third-party trademarks, product images and other intellectual property remain the property of their respective owners.

You may not reproduce, distribute, commercially exploit or modify our protected content without appropriate permission, except where permitted by law.

23. Third-Party Websites & Services

Our website may contain links to websites, platforms or services operated by third parties.

Sanitize Today does not control independent third-party websites and is not responsible for their content, availability, security or privacy practices.

Use of a third-party service may be subject to that provider’s own terms and policies.

24. Privacy & Personal Information

Personal information collected through our website, orders and customer interactions is processed in accordance with our Privacy & Personal Information Policy and applicable law, including POPIA.

Our Privacy & Personal Information Policy explains how we collect, use, store, share and protect personal information.

25. Website Security

We take reasonable measures to maintain the security and integrity of our website.

However, no internet service can be guaranteed to be completely free from interruptions, errors, malicious software or unauthorised interference.

Customers are responsible for taking reasonable precautions when accessing websites and electronic communications.

26. Limitation of Liability

To the fullest extent permitted by applicable law, Sanitize Today will not be liable for indirect, incidental or consequential loss arising from circumstances outside our reasonable control or from misuse of products contrary to their instructions.

Sanitize Today does not exclude or limit liability where doing so would be prohibited by applicable South African law.

Nothing in these Terms & Conditions is intended to exclude liability for gross negligence or any liability or consumer remedy that cannot lawfully be excluded or limited.

27. Indemnity

To the extent permitted by law, you agree to indemnify Sanitize Today against loss, damage, claims or reasonable costs resulting directly from your unlawful use of our website, intentional misuse of our products or material breach of these Terms & Conditions.

This indemnity does not apply where the loss results from conduct for which Sanitize Today is legally responsible and does not limit rights that cannot lawfully be waived.

28. Events Outside Our Reasonable Control

Sanitize Today will not be responsible for delays or failures caused by events outside our reasonable control to the extent permitted by law.

These may include:

Natural disasters;
Severe weather;
Fire;
Flooding;
Civil unrest;
Labour disruptions;
Transport interruptions;
Courier network disruptions;
Power or telecommunications failures;
Government restrictions;
Supplier interruptions; or
Other circumstances reasonably beyond our control.

We will make reasonable efforts to minimise disruption where practical.

29. Fraud & Suspicious Transactions

Sanitize Today reserves the right to delay, investigate or decline a transaction where there are reasonable grounds to suspect:

Fraud;
Unauthorised payment;
Identity misuse;
Pricing manipulation;
Website abuse; or
Other unlawful activity.

We may request reasonable verification before processing or releasing an order.

30. Business Customers

Where products are purchased for commercial, industrial, institutional or business use, additional quotation, account, credit, delivery or supply terms may apply.

Where separate written terms have been agreed with a business customer, those terms will apply together with these Terms & Conditions to the extent that they are compatible.

The application of consumer legislation to a business transaction may depend on the circumstances and applicable law.

31. Complaints & Disputes

If you have a complaint regarding an order, product or service, please contact Sanitize Today first so that we have an opportunity to investigate and resolve the matter.

Nothing in these Terms & Conditions prevents a consumer from approaching a regulator, ombud, tribunal, court or other body where they have a legal right to do so.

Where appropriate and agreed between the parties, a dispute may be referred to mediation or arbitration.

We have not retained the old compulsory AFSA arbitration wording because you don’t want the Terms suggesting that a consumer has surrendered statutory dispute-resolution rights.

32. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with subject to applicable South African law and the jurisdiction of an appropriate court, tribunal, regulator, ombud or other competent body.

33. Changes to These Terms & Conditions

Sanitize Today may amend these Terms & Conditions from time to time.

The latest version will be published on our website and the Last Updated date will be amended accordingly.

Changes will generally apply prospectively and will not retrospectively remove rights that have already accrued to a customer.

Where applicable law requires notice or consent for a particular change, we will comply with those requirements.

34. Severability

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as severable to the extent necessary.

The remaining provisions will continue to apply to the extent permitted by law.

35. Entire Agreement

These Terms & Conditions, together with any applicable order, quotation and policies incorporated by reference, constitute the terms applicable to the relevant transaction unless separate written terms have been agreed.

Nothing in this clause excludes representations, rights or obligations that cannot lawfully be excluded.
